1. Scope
   The following terms and conditions apply exclusively to orders placed by end consumers via our online shop, by telephone or in one of our sales outlets.

2.2. Order/Customer Account
Using our online portals, you have the option of ordering the items listed there via online form or by phone. If you have provided the information requested during the ordering process and submitted your order, you are submitting a binding offer to us. Telephone and online orders are legally equivalent. By placing an order, you declare that you accept the General Terms and Conditions, the right of withdrawal, and the privacy policy, and that you wish to purchase the ordered items.

2.3. Acceptance of offer/conclusion of contract
By automatically sending the order confirmation via email after receipt of your order, we accept the offer (your order). You can and should save and/or print our Terms and Conditions as well as the order confirmation. We do not store all contract data. The contract, order, and business language is German.

2.4. Possibilities for contesting the decision
Should our order confirmation contain spelling and/or printing errors, or should our pricing be based on technical transmission errors, we reserve the right to contest the order, in which case we must prove our error to you. Any payments already made will be refunded immediately.

2.5. Ordering by telephone
If you order by telephone, a contract is concluded by telephone transmission. When ordering by telephone, your order details will be requested verbally, and a customer account may be created.

3. Retention of title
We retain title to all items delivered by us until all our claims against you or the person who accepted the items have been satisfied. To enforce our retention of title, we are entitled to demand the immediate return of the items, excluding any right of retention, unless the counterclaims are legally established or undisputed.

Before transfer of ownership, pledging, transfer by way of security, processing or modification is not permitted without our consent.

4. Delivery conditions

4.1 General Terms and Conditions

Delivery is only available within Austria and Germany. Billing addresses from the entire EU are accepted. For orders from other EU countries, please contact us by email: office@kernel-crunch.com

Billing is done in euros.

When the goods are dispatched, the risk of loss or damage to the goods shall only pass to the consumer when the goods are delivered to the consumer or to a third party designated by the consumer who is different from the carrier.

4.2. Shipping costs
The respective packaging and shipping costs for delivery addresses in Austria and Germany are available on our website www.kernel-crunch.com . These are updated regularly and will be charged in addition to the order value. Information on packaging and shipping costs to other countries can be provided upon request by email to office@kernel-crunch.com.

Shipping costs are automatically calculated when you place your order and added to your purchase value.

4.3. No delivery possible
If delivery of the goods fails due to your fault, we may withdraw from the contract. In this case, any payments already made will be refunded. Any costs incurred as a result will be charged to the purchaser/buyer in the same amount.

4.4. Transport damage
If goods are delivered with obvious transport damage, a claim must be made immediately to the delivery person. Furthermore, we ask that you document any damage and contact us immediately. This will help us assert our own claims against the carrier or transport insurance.

5. Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. Inform us of your decision to withdraw from this contract in an unambiguous statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the withdrawal deadline, it is sufficient to send your notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

6. Consequences of revocation
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; under no circumstances will you be charged any fees for this refund.

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

7. Terms of payment

7.1 General

Billing is in euros. All prices listed in the shop are per item and include statutory VAT. Packaging and shipping costs are listed separately.

7.2. Payment methods
Payment is only possible by credit card or advance bank transfer. If you have chosen advance bank transfer as your payment method, please note that your order will not be processed until we receive your payment. Upon shipment of the ordered products, the buyer will receive an invoice electronically to the email address provided.

For advance payment:

The invoice amount must be transferred to the account of Maximilian Rodlauer eU, Bank 99, IBAN AT72 1912 0000 5762 8710. Any transaction fees are to be borne by the buyer.

8. Warranty
The warranty is provided in accordance with statutory provisions. Detailed information on any additional warranties and their exact terms and conditions can be found for each product on our website at www.kernel-crunch.com .

9. Final provisions

9.1 Applicable law
The contracting parties agree to the application of Austrian law. If the consumer has his or her domicile or habitual residence in Austria, or is employed in Austria, jurisdiction for any action against him or her shall be established only in the court within whose district the domicile, habitual residence, or place of employment is located.

9.2. Contract language
The contract language is German.

9.3 Minimum age
To place orders with Maximilian Rodlauer eU, you must be at least 18 years old.

9.4 Protection of intellectual property

The texts, images, sounds, graphics, animations, and videos, as well as their arrangement on our website, are protected by copyright law and other protective laws. The content of this website may not be copied, distributed, modified, or made accessible to third parties.

We guarantee the careful handling of all personal data provided to us in compliance with applicable data protection laws for the purpose of fulfilling the purchase contract.

The subject is the personal data that the customer needs for an order process.

Personal data/application/disclosure

The data received from clients or contractual partners (title, name, address, email address, telephone number, payment method, credit card details) are collected, processed, and used exclusively to the extent necessary for the establishment, design, or modification of the purchase contract. We are entitled to transmit this data to partners commissioned by us to execute the purchase contract, insofar as this is necessary to safeguard our rights and obligations under the purchase contract. We will process and use the data received from the client ourselves for the purposes of consulting, advertising, market research, and the needs-based design of offers.

10.2 Modification or deletion of personal data
Changes or deletions can be recorded in the customer account at any time.

10.3 Cookies
We would like to point out that, to simplify the purchasing process and for subsequent contract processing, the webshop operator stores the user's IP data in cookies, as well as the customer's name, address, and credit card details. Data is not transferred to third parties, with the exception of credit card details to payment service providers for the purpose of payment processing.

After completing the virtual shopping experience, the data stored in the cookies remains stored until the invoice has been paid in full. Data such as the contractual partner's name, address, and credit card details are stored until the goods are delivered (or "until the warranty period expires). Data processing is based on the statutory provisions of Section 96 (3) of the Telecommunications Act (TKG) and Section 8 (3) (4) of the Data Protection Act (DSG)."

If you cancel the purchase process, the data stored in the cookies will be deleted.
